Home Solicitation Sale Permits

PERMIT PROCESS

Step 1: Get Fingerprinted!

You will need your fingerprints completed by the Orange County Sheriff's Office in order to be considered for a Home Solicitation Sale Permit. The cost for fingerprinting is $9.00 (cash only). You can get this done at the following location, please note: you must schedule an appointment and you will need to bring your original fingerprint card with you to apply for the permit.

Step 2: Apply!

Bring your fingerprint card with you to the Orange County Clerk's Office to fill out your Application for the Home Solicitation Permit. We will take two photographs for your permit at this time. Complete the application and submit a payment for the application fee, which is $45.00. This payment should be in the form of a cashiers check, money order or cash. You will also need to bring a check or money order in the amount of $24.00, made payable to Florida Department of Law Enforcement for the processing of your fingerprints. This fee is non-refundable. What Happens Next?

Your fingerprints and application will be sent to the Florida Department of Law Enforcement (FDLE) for state processing and the Orange County Sheriff for a criminal background investigation. Both the sheriff and the FDLE shall report to the Clerk of the Circuit Court within 60 days after receipt of the fingerprints and copy of the application. If your application is approved, the Clerk will issue and send out your permit to the employer's address listed on your application. If you are self-employed, your permit will be sent to your local address listed on your application. If your permit is not approved, you will be notified by the Clerk's Office in a letter sent via Certified Mail to the address listed on the application. A copy of the statute is available upon request for a fee of $1.00 per page.

The Home Solicitation Sale Permit is valid for one year from the date of issuance.

PERMIT INFORMATION

Who must carry a Permit?

Florida Statutes Chapter 501: Consumer Protection addresses Home Solicitation and states that it is unlawful for any person to conduct any home solicitation sale...in this state without first obtaining a valid home solicitation sale permit as provided in this section.
(FL. Stat 501.022) In other words, if you intend to sell a product or service door-to-door in Orange County, you may need to apply for this permit.

How much does the permit cost?

The cost for obtaining the permit from the Clerk of the Court is $68.00. This includes two fees which must be paid separately: the Clerk fee is $45.00 and the FDLE fee which is $24.00. This does not include the fee for fingerprinting, which is completed at the sheriff's office prior to applying for your permit.

What do I need to apply?

You will need to complete an Application for the permit, as well as valid photo identification (driver's license or state-issued photo ID), a completed fingerprint card, obtainable through any local law enforcement agency, and a payment of $45.00, in the form of cash, cashiers check or money order (made payable to the Clerk of the Court). You will also need a payment of $24.00, in the form of cashiers check or money order (made payable to the Florida Department of Law Enforcement). Please be advised that there are other laws concerning what type of license you may need to obtain to do certain types of work in Orange County. A prospective contractor should consult Chapter 489: Contracting. -- to see if you are required to obtain an Occupational License, certification, or registry. If you are required to obtain a contractor license to conduct your business in Orange County, we advise you to do so prior to applying for the Home Solicitation Sale Permit.

Who is exempt?

The law states that many different types of salespeople or "agents" are excluded from the operation of this section. You may want to read the law to see if this applies to you in
FL. Stat. 501.022 (1)(b). It states that solicitors, salesperson, or agents making calls or soliciting orders on behalf of religious, charitable, scientific, educational, or veterans' institution or organization holding a sales tax exemption certificate under S. 212.08(7) are exempt.

What else do I need to know?

Florida Law requires that "every home solicitation sale shall be evidenced by written agreement" as stated in Statute 501.031. Home solicitation sale; written agreement.
